1. Scope of application
These terms and conditions govern the contractual relationship between the landscape architect and the client.
The general terms and conditions are deemed accepted upon payment of the price of the service by the client.
Any deviation from these general conditions must be in writing.
1. Subject of the contract
The Architect's services relate to advising and assisting the Client in the choice of one or more interior plants and other advice, based on the indications given by the Client and the Client's answers to the questions asked (colours, etc.).
The architect will also provide the client with a brief analysis of the plant or plants proposed, based on the principles of chromotherapy.
1. Prices, terms and conditions of payment
The following fixed price formulas are available:
Advice for one plant
Advice for two plants
eAdvice for three plants
The price does not include the supply of the plant(s).
Payment is made in advance, before any advice is given by the landscape architect.
The following methods of payment are accepted:
Credit card ;
Paypal account.
Please note that no refunds will be made, even if the customer decides to cancel the order process.
1. Response time
The processing of the customer's request varies according to the scope of the service required.
In principle, the landscape architect will respond within seven working days.
Depending on the client's final choice, the landscape architect will provide a brief analysis of the plant or plants proposed, based on the principles of chromotherapy, within a further seven working days.
The landscape architect cannot be held responsible if this deadline is exceeded.
1. Liability
The landscape architect is bound by an obligation of means and not of result.
The landscape architect accepts no liability for any damage or loss resulting from the performance of the contract. The landscape architect also accepts no liability for damage caused by any auxiliaries. The landscape architect cannot be held liable if the recommended plant causes any harm to the client, his surroundings or his property.
1. Data protection
The following data in particular must be provided by the customer:Postal address ;Telephone numberE-mail addressPlant storage location (type of room, light, presence of other plants, etc.);
PhotosAllergies.The Client is obliged to provide truthful information.The architect cannot be held liable for any damage if the data provided is or proves to be false.All personal data is treated as confidential.
All information necessary for the execution of the contract will be subject to computer processing and may be communicated to associated companies.
The customer accepts that all correspondence will be sent by unencrypted e-mail, in the knowledge that this method does not offer all the guarantees of confidentiality of postal mail.
1. Additional services
Any additional services not included in the formulas described in ch. 3 above will be invoiced separately.
1. Cancellation
In the event of early termination of this contract, the client is reminded that no refund may be requested from the landscape architect.
1. Applicable law and place of jurisdiction
This contract is subject to Swiss law.
Any dispute arising from this contract, whether relating to its conclusion, performance, termination or validity, shall be submitted to the competent Vaud courts at the domicile of the landscape architect.Terms of confidentiality
